Divorce mediation is an increasingly popular alternative to the adversarial system of divorce. Mediation is when two people come together, with a neutral mediator, and write up an agreement, thus avoiding the need to go to court as adversaries.
Mediation is a voluntary process where the neutral mediator helps people come to an agreement. The process of mediation is based upon respect for the parties’ autonomy, and their ability to reach a fair agreement. Either party may withdraw at any time and the mediator has no power to decide the outcome absent consensus.
Traditional divorce often intensifies family conflict but mediation is designed to mitigate it and limit the emotional effect of the divorce on everyone involved, particularly the children.
Once an attorney is hired as a mediator, that attorney may not be retained as a lawyer by either party. Succesful mediation is not possible without both parties providing full dicolosures of the marital estate.
